Welcome to ClarityHealth.com (“Site”) which is owned and operated by Clarity Health Services, Inc. (“Clarity”). Clarity makes available for your use on the Site certain content (“Content”). Your access to and use of the Site is subject to these Terms of Use (“Terms of Use”) and all applicable laws. Your use of the Site constitutes your agreement to all of the terms contained herein.

We reserve the right to change the Terms of Use at any time without prior notice, effective immediately upon posting on this Site. By using the Site subsequent to any revision of the Terms of Use, you agree to be bound by such changes. Clarity has the right to terminate your access or use of this Site at any time without notice.

No Medical Advice. The information provided on this Site is for educational purposes only and should not be interpreted as a recommendation for a specific treatment plan, service or course of action. Clarity does not provide specific medical advice, is not engaged in providing medical or professional services and does not endorse any medical or professional service obtained through information provided on this Site. In addition, while we frequently update the Site’s contents, information changes rapidly and therefore, some information may be out of date, and/or contain inaccuracies or typographical errors.

User Conduct. If you have a unique user identifier and/or password to access secure areas, you are responsible for protecting the identifier and/or password and for any unauthorized use by others, with or without your permission.

You are responsible for all software and equipment necessary to access and use this Site, including all related expenses. In addition, you are solely responsible for maintaining the confidentiality of any password or other security measure you use in connection with this Site, and agree to notify Clarity immediately of any unauthorized use of your password or other security measure.

While on this Site, you may not:

  • Impersonate another person or entity, or post, publish, upload, or in any way distribute, transmit or disseminate (collectively “Post”) any message anonymously or under a false name;
  • Use the Site or Services in any manner that adversely affects the Site’s resources or availability of the Site or Services to others, or in a manner that violates any local, state, national or international law;
  • Defame, harass, threaten, stalk, abuse or otherwise violate the legal rights (such as the rights of privacy and publicity) of others;
  • Post any obscene, pornographic, profane, or otherwise objectionable information or unlawful information;
  • Post any material that infringes any patent, copyright, trademark, trade secrets (“Intellectual Property”) of any party, unless you are the owner of the Intellectual Property or have the permission of the owner to post or transmit such material;
  • Post any personally identifiable information (PII) or protected health information (PHI), the latter as defined by the Health Insurance Portability and Accountability Act (HIPAA) of 1996, about a third party without that third party’s consent and in contravention of any local, state or federal law (including without limitation, HIPAA);
  • Collect information about others without their consent;
  • Post any corrupted files, files that contain computer viruses or other destructive features, or any other software or programs that may corrupt of damage another party’s computer;
  • Engage in any commercial activities, including advertising or offering to sell any goods or services;
  • Post chain letters, pyramid schemes, surveys, contests, charity requests or petitions for signatures;
  • Mass-post, cross-post, or post off-topic messages to any newsgroup, chat room or bulletin board service;
  • Spam* (see definition below);
  • Interfere with, restrict or inhibit other users of this Site; or
  • Knowingly solicit or collect personal information from a child 13 years or younger.

*Clarity defines “Spam” as the sending of electronic messages, individually or en masse, to people who did not request it and/or would not otherwise choose to receive it regardless of whether sent by a business, an individual, or a nonprofit.

Clarity may immediately terminate your access to the Site or any portion of the Site without notification for violation of any of the foregoing rules of user conduct.

Your Content. You own and are solely responsible for any content that you post on or through the Site and/or submit/transmit through Services (“Your Content”). Clarity does not claim any ownership rights in Your Content. By Posting Your Content through the Services, you automatically grant, and you represent and warrant that you have the right to grant, to Clarity a limited, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute Your Content for any purpose on or in connection with the Services. If you choose to remove Your Content, the license granted above will automatically expire.

Monitoring. Clarity has no obligation to monitor any member’s use of the Site or retain the content of any user session. However, Clarity reserves the right at all times and without notice to delete any content and to monitor, review, retain and/or disclose any content or other information in Clarity’s possession, however obtained, about or related to you, your use of the Site or otherwise as necessary or useful to satisfy any applicable law, regulation, legal process, or governmental request. Clarity is not responsible for any failure or delay in removing content.

No Warranty. The Site is provided “As Is.” Clarity does not warrant that any Content, or any other content posted on this Site is accurate, complete, reliable, current or error-free. Clarity does not warrant this Site will meet your requirements, or that your access or use of this Site Services will be uninterrupted, timely, secure or error-free, nor does Clarity make any warranty whatsoever regarding the quality of any products, services, information or any other material you obtain through this Site. Limitation of Liability. EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, NEITHER CLARITY NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, LICENSORS, CONTENT PROVIDERS, SUPPLIERS OR OTHER REPRESENTATIVES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL AND/OR EXEMPLARY DAMAGES, ARISING FROM THE USE OR PERFORMANCE OF THIS SITE OR FROM ANY INFORMATION, CONTENT, SERVICES OR PRODUCTS PROVIDED THROUGH THIS SITE, EVEN IF CLARITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THIS SITE, OR ANY PORTION THEREOF, YOUR EXCLUSIVE REMEDY SHALL BE TO CEASE USING THE SITE AND/OR THE SERVICES. Except where otherwise indicated, the Content featured or displayed on this Site and/or through the Services, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations and software, belongs to Clarity, its licensors and its content providers, and is protected by copyright, trade dress, moral rights, trademark and other laws, to the fullest extent applicable under both United States and foreign laws. Unauthorized use of the Content could subject you to liability under copyright, trademark, trade dress, unfair competition, and other laws of the United States.

The Content may not be used except as provided in these Terms of Use or without the written permission of Clarity. Clarity authorizes you to copy materials on this site to a hard drive solely for the purpose of viewing and using the Site on your computer. You may also print portions of the Site in hard copy for the sole purpose of facilitating your personal, noncommercial use and retention of information from the Site. Clarity makes no guarantees and disclaims any implied representations or warranties about the accuracy, relevance, timeliness, completeness, or appropriateness of these sites, the information contained in them or the products or services they provide. Clarity shall not be liable, directly or indirectly, for any damage or loss incurred by you in connection with web sites or resources accessed through links on this Site.

Linking to and Framing of this Web Site. You may not frame any Content, or use any trademark, logo or other proprietary information on this Site, without Clarity’s express written consent. You may not use Clarity’s name or trademarks in any meta-tags or other hidden text without the express written consent of Clarity. You may link to this Site for non-commercial purposes only. Clarity reserves the right to demand you remove any such link at any time, for any or no reason, and at Clarity’s sole discretion.

Governing Law and Disputes. These Terms of Use, and any dispute that may arise between you and Clarity, will be governed by the laws of the State of Washington without regard to conflict of laws principles. The Terms of Use, as may be amended from time to time, set forth the entire understanding between you and Clarity as to the subject matter of the Terms of Use, unless otherwise specifically provided under a written agreement, and supersede any prior agreements between you and Clarity, whether oral or written, as to the subject matter of the Terms of Use. Jurisdiction and venue will be in the courts of King County, Washington for any disputes arising out of or relating to these Terms of Use. You and Clarity agree that any cause of action arising out of or related to the Site must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. Some jurisdictions may prohibit the shortening of the time period in which a cause of action must be brought. In all such jurisdictions, the applicable time period shall be the minimum allowed by law.

Unsolicited Submissions/Feedback. Clarity does not accept or consider unsolicited ideas, including ideas for new products, services, technologies, processes, marketing plans or new product names. Please do not send any original artwork, samples, demos or other works. If you do send such materials, Clarity makes no assurances that your ideas and materials will be treated as confidential or proprietary. Any feedback you provide on this Site will be deemed non-confidential. Clarity is free to use such information on an unrestricted basis.

International Use. Clarity makes no representation of any kind that all content, materials and services on the Site are appropriate or available for use in all geographic locations, especially some locations outside the United States, and accessing such from certain locations may be illegal and prohibited. Those accessing the Site from such locations act on their own initiative and we are not responsible for their compliance with applicable laws.

Miscellaneous. If any provision of the Terms of Use is found to be invalid or unenforceable, the remainder of the Terms of Use shall remain in full force and effect, and all Terms of Use shall be enforced to the fullest extent permitted by law. No waiver or failure to assert any provision of the Terms of Use shall be valid unless in writing and signed by an officer of Clarity. Notice and Procedure for Making Claims of Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Clarity that your copyrighted material has been infringed.

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

A description of the copyrighted work that you claim has been infringed upon;

A description of where the material that you claim is infringing is located on the Site;

Your address, telephone number, and e-mail address;

A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
